Terms of Service
These Terms govern your use of lotbook, at lotbook.ca and related services (the "Service"), operated by DG Fintech Inc. By using the Service or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

What lotbook is
lotbook compiles and presents information about municipal development applications — rezonings, site plans, official plan amendments, committee of adjustment matters, and similar — from public open-data sources and public planning portals, together with facts extracted from planning documents. It is an information tool, described further on our Methodology and About the data pages.
Accuracy, delay, and no reliance
This section is important. Please read it.
- The information in lotbook is derived from municipal sources and, in part, extracted automatically by software, including language models. It may be incomplete, out of date, or inaccurate, and it is not the official record.
- The free tier is intentionally delayed by approximately seven days. Free users are not seeing current information.
- lotbook is not legal, planning, engineering, appraisal, investment, or real-estate advice, and using it does not create any professional or advisory relationship.
- Do not rely on lotbook for any legal, financial, development, or transactional decision. Always verify against the official records of the relevant municipality before acting. You are solely responsible for independently confirming any information before you rely on it, and you assume all risk of any reliance.
Eligibility and your account
You must be at least 18 years old (or the age of majority where you live) to create an account. You agree to provide accurate information, to keep your password confidential, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use. You may not share, sell, or transfer your account.
Acceptable use
You agree not to:
- scrape, crawl, bulk-download, or systematically extract the Service's data, except through functionality we expressly provide;
- resell, sublicense, republish, or redistribute the Service's compiled data or content, or use it to build a competing dataset or product;
- circumvent, disable, or defeat the free-tier delay, access controls, rate limits, or any paywall;
- reverse engineer, decompile, or attempt to derive source code, except where that restriction is prohibited by law;
- use the Service unlawfully, to infringe others' rights, or to transmit malware;
- interfere with or place an unreasonable load on the Service, or attempt to gain unauthorized access to it or its systems.
We may set and enforce reasonable usage and rate limits.
Subscriptions, billing, and cancellation
Tiers. lotbook offers a free tier, a Pro subscription (CAD $119 per seat per month), and a Team plan (contact us). Prices are exclusive of applicable taxes, which will be added where required.
Payment and renewal. Paid subscriptions are billed through Stripe and renew automatically each billing period until cancelled. By subscribing, you authorize us, through Stripe, to charge your payment method on each renewal.
No free trial is offered at this time. If we offer a trial in the future, its terms (including any one-per-customer limit) will be presented at sign-up.
Cancellation. You may cancel at any time through the Stripe billing portal linked from your account. On cancellation, your paid access continues until the end of the current billing period, after which your account reverts to the free tier. If a payment fails, we may retry and temporarily maintain access during a grace period before downgrading.
Refunds. Payments are non-refundable except where required by law. Cancelling stops future renewals; we do not refund the unused portion of the current billing period.
Price changes. We may change prices. We will give notice of a change to your plan before it takes effect on your next renewal; the change does not affect the period you have already paid for.
Intellectual property
Our rights. The Service — its software, design, the lotbook name and Parcel mark, and the selection, arrangement, and compilation of the data — is owned by DG Fintech Inc. and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own internal business or personal purposes, subject to these Terms.
Underlying public data. The factual municipal data underlying the Service comes from public sources. Toronto development-application data is used under the Open Government Licence – Toronto; the Service contains information licensed under that licence. We do not claim ownership of the underlying public facts, and we preserve required attributions. We do not republish or host third-party copyrighted planning documents; we present extracted facts and link to sources.
Your content. You retain your rights in the searches and watch areas you create. You grant us a licence to store and process them as needed to provide the Service to you.
Feedback. If you send us suggestions, we may use them without obligation to you.
Third-party services
The Service relies on third parties (including Stripe for payments and the providers listed in our Privacy Policy). Your use of those services through lotbook may also be governed by their terms. We are not responsible for third-party services.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or accuracy, completeness, timeliness, or availability of the data. We do not warrant that the Service will be uninterrupted or error-free. lotbook is an independent product and is not affiliated with or endorsed by the City of Toronto or any municipality. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, DG Fintech Inc. and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or relating to your use of (or inability to use) the Service or any reliance on its content — even if advised of the possibility. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or CAD $100. Nothing in these Terms excludes liability that cannot be excluded by law, including under applicable consumer-protection legislation.
Indemnification
You agree to indemnify and hold harmless DG Fintech Inc. and its operators from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your infringement of any third party's rights.
Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or its users. On termination, the licences granted to you end; sections that by their nature should survive will survive.
Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute, except where applicable consumer-protection law gives you a different, non-waivable right — for example, Québec residents may have rights under Québec law.
Changes to these Terms
We may update these Terms. If a change is material, we will update the effective date and, where appropriate, notify account holders. Your continued use after a change takes effect means you accept the updated Terms.
General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a reorganization or sale. We are not liable for delays or failures caused by events beyond our reasonable control.
